View Full Version : Reminder: U.S. Sales Tax Refund Request [April 14, 2015]

As of January 2015, DR MyCommerce, Inc., eSellerate's parent company and our
main credit card processor, is registered to collect sales tax on behalf of
the state governments of all U.S. states that have sales tax. In some of
those states, sales tax might or might not be collected depending on the
contents of your shopping cart. All sales taxes collected by eSellerate are
remitted to the appropriate taxation authorities.

Customers whose organizations are exempt from paying sales tax can receive a
full refund of the sales tax amount, credited back to the same
payment account used for the order.

To receive a refund of state sales tax after placing an order:

1) Send an e-mail message to csfileattachment@digitalriver.com with a
subject line of "Sales Tax Refund Request". You can also fax the requests
to 952-253-8760.

2) In the e-mail message, include the order ID shown on your receipt /
invoice. The order ID always begins with "ST" (e.g., "ST123456789").

3) In the e-mail message, please attach your organization's tax exempt
documentation. This may be a certificate, tax form, or other
government-issued documentation.

4) Please send a quick note to sales@lindersoft.com so we can monitor the
refund process.

Once your refund has been processed, eSellerate Support will reply by e-mail
and confirm the refund. The funds will post back to the payment
account (e.g., credit card) used for the order within 3-5 business days, or
sooner.

Why would they do that? It is not their business to collect sales taxes.
From now on I am going to Fax you a check directly

Because it's US tax law and Digital River have no choice. In fact, they are
processing sales tax for 5+ years now.

For example, this order from "Colorado Springs, Colorado", November 17,
2010:

> Sub Total: $399.00
> Tax: $11.57

So it's not really a new thing.

Do you where I can see that U.S. Law?
Never heard it before. Is that for overseas on line sellers?
I only have to charge sales tax when I sell to someone in my state.

In CA, at least, it's always been the law that you have to pay a "use
tax" on taxable merchandise that's bought from outside the state when
no tax was collected.

Since people weren't doing that, it's being done for them now by the
"big guys" who are mandated to do it.

Amazon does it now, as well.

There have been several international treaties about taxation of
electronically deliverable goods for the past decade or so.

This is for *all* online sellers of digital goods. If a business has a
physical presence (aka "nexus") in a state, such as a store, office or
warehouse, you must collect applicable state and local sales tax from
customers. And all the big boys are registered to collect sales tax on
behalf of the state governments of all U.S. states that have sales tax now.

Just Glad non of my on-line services charge sales tax. My customers would
have a nit fit.
I work out of my back yard, so I should be safe <g>.

All this is a nightmare and it got even worse. Sales tax for most U.S.
states now, then VAT for all the different European countries. Where is
Chuck Norris when you need him?

If they get enough volume, they do. Problem is, it requires LOTS of volume.
